General Terms of the Entrusted Customs Declaration Agreement
Responsibilities of the Entrusting Party
The entrusting party shall promptly provide all the documents required for customs declaration and inspection, and shall be responsible for the authenticity, accuracy and completeness of the documents.
The entrusting party shall be responsible for promptly and fulfillingly paying the agency customs declaration fees, the advanced fees, as well as the demurrage charges, late fees and various fines imposed by the customs and other law - enforcement units according to law after the customs broker has completed the customs formalities.
Be responsible for transporting the goods to the designated place as required by the customs.
Be responsible for assisting the customs in inspection together with the customs declarant of the entrusted party, answering the customs inquiries, cooperating with relevant investigations, and bearing the relevant costs incurred.
In the case where the entrusted party cannot obtain a sample of the goods before customs declaration, bear the responsibility for the consistency between the documents and the goods.
Responsibilities of the Entrusted Party
Be responsible for answering the entrusting partys questions regarding customs declaration.
Be responsible for conducting a “reasonable review” of the authenticity and completeness of the goods information and documents provided by the entrusting party. The review content includes: (1) Information proving the actual situation of the imported and exported goods, including the name, specifications, uses, place of origin, trade mode, etc. of the imported and exported goods; (2) Commercial documents related to the imported and exported goods, such as contracts, invoices, transport documents, packing lists, etc.; (3) License documents and accompanying documents required for import and export; (4) Processing trade (paper - based or electronic data) and other import and export documents required by the customs.
For reasons such as determining the name and classification of the goods, with the approval of the customs, the goods can be inspected or samples can be taken.
After receiving the complete accompanying documents delivered by the entrusting party, be responsible for carefully filling out the customs declaration form based on the documents provided by the entrusting party in accordance with the “Regulations on the Filling of Customs Declaration Forms of the Peoples Republic of China”, bear the responsibility for the “consistency between documents”, declare to the customs and handle customs formalities within the time stipulated by the customs and agreed in this entrusted customs declaration agreement.Export ClearanceBe responsible for promptly notifying the entrusting party to jointly assist the customs in inspection and cooperate with the customs in relevant investigations.
Be responsible for paying the direct economic losses caused to the entrusting party due to the responsibility of the customs broker, as well as the demurrage charges, late fees and various fines imposed by the customs and other law - enforcement units according to law.
Be responsible for returning the documents and files related to the entrusted content that have completed the customs formalities to the entrusting party or its designated personnel within the time agreed in this power of attorney (see the “Other Requirements” column of the “Entrusted Customs Declaration Agreement” for details).
Principle of Compensation
The entrusted party shall not be liable for losses caused to the entrusting party due to force majeure. For losses caused by other negligence, it shall be agreed upon by both parties or handled in accordance with the provisions of relevant national laws and regulations. The entrusting party may avoid such risks through insurance. Liabilities Not Borne
Each of the two contracting parties shall not be liable for the direct economic losses, demurrage charges, late fees and relevant fines caused by the other party. Principle of Charging
The customs declaration fees for general goods shall be implemented in principle in accordance with the local “Guidance Price for Customs Brokerage Industry Charges”. For special commodities, it can be negotiated separately by both parties. Legal Compulsion
When any clause of this “Entrusted Customs Declaration Agreement” is inconsistent with the “Customs Law” and relevant laws and regulations, the laws and regulations shall prevail. However, it does not affect the validity of other clauses of the “Entrusted Customs Declaration Agreement”. Matters for Consultation and Resolution
When changing or terminating this agreement or when a dispute occurs between the two parties, it shall be handled in accordance with the relevant provisions and procedures of the “Contract Law of the Peoples Republic of China”. In case of problems arising from reasons other than the two contracting parties or when the customs declaration business requires modification of the agreement clauses, a supplementary agreement shall be negotiated and concluded. The two parties may sign supplementary clauses within the scope permitted by laws and administrative regulations, but the supplementary clauses shall not conflict with the content of this agreement.
