On April 24, 2024, Japans Ministry of Finance announced that, based on applications from domestic graphite electrode manufacturers SEC Carbon Co., Ltd., Tokai Carbon Co., Ltd., and Nippon Carbon Co., Ltd., it has decided to initiate an anti-dumping investigation into graphite electrodes originating from mainland China. The products under investigation fall under Japanese Customs Tariff Code 854511.
This decision is based on formal applications submitted by domestic manufacturers on February 26, 2024. These manufacturers allege that graphite electrodes exported from mainland China to Japan are being sold at dumped prices, which may cause significant harm to the domestic industry.
The timeframe and scope of the investigation are as follows:
(1) Dumping Investigation Period:The alleged dumping occurred between October 1, 2022, and September 30, 2023. (2) Industry Injury Investigation Period:The period for assessing the impact of dumping on Japans domestic industry spans from January 1, 2018, to September 30, 2023.
Dumping refers to a situation where exporters sell goods in foreign markets at prices lower than their normal domestic market prices. This price disparity may lead to unfair competition and price pressure in the importing countrys market, harming local manufacturing interests.
Investigation Process:
Japans Ministry of Finance will first conduct necessary investigations to determine whether dumping exists. This includes comparing the domestic sales prices of Chinese manufacturers with their export prices to Japan. If significant price differences are found, further analysis will assess their impact on the Japanese market.
Simultaneously, Japans Ministry of Finance will evaluate domestic market conditions since 2018 to analyze whether the domestic industry has suffered material injury or faces a threat of injury due to dumping. This involves examining multiple dimensions, including market share changes, sales volumes, profit margins, output, and employment.
Upon completing preliminary investigations, if initial evidence supports the existence of dumping, Japans Ministry of Finance may impose provisional measures. Under WTO rules, this could include temporary anti-dumping duties on the alleged dumped products until the investigation is finalized.
Next Steps:
After collecting and analyzing all relevant data, Japans Ministry of Finance will make a final decision on whether to impose anti-dumping duties. This decision will be based on a detailed economic analysis report to ensure compliance with domestic and international trade regulations and market fairness.
