Starting from July 21, 2023, Australia will implement new authorization management regulations for decabromodiphenyl ether (decaBDE) and perfluorooctanoic acid (PFOA), its salts, and related compounds.import and exportImporters and exporters of these chemicals must obtain annual authorization from AICIS to legally conduct import and export activities within the registration year. Enterprises can submit applications online through the AICIS Business Services System and pay the corresponding fees.
I. New Authorization Management Regulations
1.1 Regulated Substances:Decabromodiphenyl ether (decaBDE), perfluorooctanoic acid (PFOA) and its salts, and PFOA-related compounds.
1.2 Regulatory Requirements:Starting from July 21, 2023, Australian importers and exporters of the aforementioned chemicals must obtain annual authorization from AICIS to legally conduct import or export activities during the registration year.
1.3 Special Cases:These new rules do not apply if the chemicals are introduced solely for scientific research or analysis within an AICIS registration year (August 30 to September 1) and the introduction quantity is 100 kg or less.
II. Authorization Application Methods
2Application Time:Importers or exporters must apply to AICIS for import/export permits and obtain authorization before conducting import or export activities.
2.2 Application Process:Submit the relevant application forms online through the AICIS Business Services system and pay the required fees. For export authorization applications, the fees are divided into two tiers: AUD 2,395 (excl. tax) and AUD 4,780 (excl. tax), depending on whether the destination country is a party to the Convention and consents to the import.
(b) Declare to the Chinese customs for import customs clearance.
(1) Download and complete the Rotterdam Convention Annual Import or Export Authorization Application Form;
(2) Log in to the AICIS Business Services platform and select Other Applications;
(3) Choose the corresponding import or export type, fill in the business and application contact details, then click Save;
(4) Upload the completed application form under Upload Application Form;
(5) Pay the fees and submit the application form.
2.3 Application Recommendations:Enterprises with import/export plans are advised to apply at least one week in advance to ensure smooth authorization from AICIS before conducting import/export activities and to remain compliant.
Information Required for Submission
3.1 Export Activities:Submit contact information for both the exporter and importer, including ABN numbers (if applicable).
3.2 Import Activities:Submit contact information for both the importer and supplier, including ABN numbers (if applicable).
3.3 Other Information:Also submit the AICIS business registration number (if applicable), the chemicals common and trade names, CAS number, AHECC code (Australian Harmonized Export Commodity Classification), intended use (industrial, pesticide, or both), mixture information (if imported as a mixture), SDS and labels in the destination countrys official language, etc.
Enterprises involved in the import/export of industrial chemicals in Australia are advised to check whether they handle any of the regulated chemicals and apply for the necessary authorizations promptly to avoid disruptions to trade activities.
